AUSTIN, Texas, US (NVN)-- A Venezuelan man, who was shot by ICE agents, is now back in the hospital, according to the mans attorney.

His attorney Lincoln Goldfinch, says that their client, Wilber Rafael Garces Perez, still has a bullet lodged in his back, and was making a simple DoorDash delivery, when ICE agents sideswiped his car, and was shot in the back by those agents.

Perez, was then taken to the hospital, where they processed him for an early discharged, without removing that bullet from him, because doctors said it was near his spine.

In a news conference on Sunday, Perez himself told reporters that he was quickly processed, so they can speed up his transfer to a detention facility.

He continued to say that while at that detention facility, he received poor treatment, telling reporters that he had to sleep on the floor, and was given no pain meds, until a nurse gave him a "pill" on Monday.

Goldfinch says that he was taken back to the hospital Monday night, as that happened, US Representative Greg Casar said that it was a positive step in the right direction for ICE, saying in a statement:

“Now, we have to make sure he fully recovers, is reunited with his family, and gets to tell law enforcement the full story of how he was shot in the back by ICE.”

Earlier in the day on Monday, Perez told reporters that the agents didn't turn on any flashing lights or ask him to stop, until after they sideswiped his vehicle.

He says that he is not doing well at all, as that bullet is still lodged in his back, and that he hasn't received the required medical attention to take care of it.

Now, Perez has been housed in the South Texas ICE Processing Center in Pearsall, TX, which is about 130 miles (209 km) from Austin and his attorney says that he said he was being interrogated, in a prior phone conversation, as this comes after an investigation in to the shooting has began, according to DHS.
